Claim

Current posture
Active — you are self-represented
Default motions
Three filed (Mar, Apr, May 2026) — two vacated; third status unclear
Prior matter
Portilla v. Morris from 2018 — relationship context may bear on claims
Resolution path
1
Assess whether settlement is preferable to prolonged litigation
Self-representing drains time you could spend on revenue-generating matters. A clean resolution — even at cost — may be the better business decision.
2
Address outstanding default motion
If a third default motion remains active, respond promptly. Another default posture compounds procedural exposure.
3
Leverage 2018 history
The prior Portilla v. Morris matter provides factual and relational context that may support defenses or counterclaims. Review it before any settlement discussion.

Filings alleged
One pleading filed; other matters alleged to have been neglected
Billing dispute

Recommended approach
1
Evaluate engaging defense counsel
McCallion & Associates are experienced in malpractice. Self-representing against them is a bandwidth and risk calculation. Defense counsel may negotiate better terms.
2
Pull the full file before any response
Document every filing, every communication, every billing entry for the five matters alleged. Your defense depends on what the record actually shows.
3
Assess settlement window early
Pre-RJI is the lowest-cost moment to explore resolution. McCallion settles 29 out of every ~40 contested matters. There is a deal to be made before this escalates.
4
Prioritize getting this off your plate
Active defense litigation while running a practice is a capacity drain. The sooner this resolves, the more bandwidth you recover for client work and revenue.

↗ See Economic model
Why the timing matters
→
Blue Bar judgment is recent — August 2026
A fresh confession of judgment can affect banking relationships and enforcement risk. Resolving this proactively, before enforcement, is preferable to waiting.
→
CFG verdict is collectible
The Kings County non-jury verdict creates an enforceable judgment. Reaching out to CFG about a structured resolution before enforcement proceedings is worth exploring.
→
Revenue timing is the key variable
The Chen v. Astaire matter has fee potential. A strong result there — arbitration award, settlement, or CPLR 2221 reversal — generates the income that makes all of this manageable. The work is available now.
Economic model
↗
CORE THESIS
Chen v. Astaire is the highest-leverage matter you are currently working
Winning this case generates income, reference, and practice growth simultaneously
How each party maximizes
→
How Stephen maximizes
CPLR 2221 reversal reopens the litigation path. Failing that, a strong arbitration outcome recovers his claimed damages. Either way, he needs a counsel who is fully engaged and on top of the deadlines.
→
How Julio maximizes
A successful arbitration outcome generates a contingent or hourly fee on a commercial matter. It adds a Commercial Division win to the record. And it builds a client relationship with someone who has multiple active matters.
→
How both maximize together
Full engagement now — CPLR 2221 assessed, arbitration commenced on time, filings verified — keeps all options open. Disengagement or missed deadlines forecloses them. The upside is shared; the cost of inaction falls on both.
CPLR 2221 PATH
Court path reopened
If grounds exist, this is the highest-value outcome for the client — and the most valuable work you can do right now
ARBITRATION PATH
Damages recovered
Arbitration commenced by Jan 18 keeps the case alive regardless of CPLR 2221 outcome
The bigger picture for your practice
Commercial Division cases
Add this to your record — it opens doors to that practice area
Client network
Stephen Chen has matters across multiple courts — referral relationship possible
Financial obligations
Fee income from this matter directly addresses outstanding obligations — the timing aligns
Defense matters
A strong client win here creates leverage and cash to resolve the defense matters cleanly
CPLR 2221 analysis
The standard
Questions to assess for reargue
1
Did the court misapprehend any argument in the original briefs?
Review the full briefing record on NYSCEF. Identify whether any legal argument was made in the papers that the court did not address in its decision.
2
Did the court overlook any controlling authority?
Review whether the court cited and distinguished the principal cases cited in the opposition. An overlooked contrary case can support reargue.
3
Was the arbitration clause ambiguous in scope?
Courts compel arbitration only for claims that clearly fall within the clause. If any of the claims arguably fall outside it, that is a reargue ground.
Questions to assess for renew
1
Are there new facts not in the record?
New facts — discovered after briefing closed — that bear on arbitrability can support renewal. Must also justify why they were not available before.
2
Has there been a change in controlling law?
Any appellate decision issued after briefing that changes the arbitrability standard in this context is a renewal ground.
Practical guidance
Time limit
Motion to reargue must be made within 30 days of service of the order with notice of entry — confirm when defendants serve
Court’s signal
Judge Cohen noted on Oct 20 that CPLR 2221 remains available if appropriate grounds exist — this is not a hostile signal
Parallel track
CPLR 2221 and arbitration commencement are not mutually exclusive — pursue both simultaneously
Your deliverable
Written assessment to client: whether grounds exist and, if so, the specific basis for the motion
Arbitration roadmap
◯
HARD DEADLINE
Arbitration must be commenced within 90 days of Oct 20, 2026 order
January 18, 2027 — failure allows defendants to move to dismiss
Step-by-step commencement
1
Locate and review the arbitration clause
Pull the underlying agreement between Stephen Chen and Astaire Capital from NYSCEF. The clause specifies: (a) which forum, (b) what rules apply, (c) where arbitration is seated, (d) any notice requirements.
2
Identify the forum
Most commercial agreements designate AAA (American Arbitration Association) or JAMS. Confirm which. If silent, AAA Commercial Rules are the default in NY. File with the correct forum — wrong forum is a waivable defect but costs time.
AAA: adr.org/commercial — JAMS: jamsadr.com
3
Prepare the demand for arbitration
File a demand that mirrors the claims in the underlying complaint. Include: parties, nature of dispute, relief sought, and the arbitration clause as the jurisdictional basis. Under AAA Commercial Rules, file online with a filing fee.
4
Serve the demand on defendants
Serve Rob Dawes (rob@dawes.one) as counsel of record. Follow the service requirements in the arbitration clause and forum rules. Retain proof of service.
5
Notify NYSCEF of commencement
File a letter on NYSCEF confirming arbitration has been commenced, for the court record. This protects you against any future argument that the deadline was missed.

Universal opener (any part, any county)
"Good morning, Your Honor. Julio Portilla, Law Office of Julio E. Portilla, for [plaintiff/defendant] [name]. We are here on [the compliance conference / the status conference / the settlement conference / the fact-finding / trial]." Then one sentence on posture: "Since the last appearance, [what happened]." Then one sentence on the ask: "Today we ask the Court to [specific relief]." Stop talking. Let the court set the agenda.
Compliance conference — Webb III (Nov 2)
"Your Honor, discovery is [on track / partially outstanding]. Plaintiff has served [items]; defendant's [items] are outstanding since [date]. We have conferred with counsel and propose the following schedule — I have a proposed order with dates both sides can meet: depositions by [date], expert disclosure by [date], note of issue by [date]." If the other side is in default: "We ask that the order include a 3126 provision if the [date] deadline is missed." If YOU are behind: "We will have [items] served by [date] — I am prepared to be so-ordered on that." (A date you can meet. Nothing else.)
Status conference — Dowdy / Serrano / Carrasquillo (Nov 4–5)
"Your Honor, the matter is at [stage]. Outstanding: [one or two items]. We request a further status date of [60–90 days] to complete [item]." City of New York matters: "We are awaiting [50-h transcript / records from the City]; we have followed up on [dates]. We ask the Court to direct production by [date]." Foreclosure status: "The borrower [has a complete loss-mitigation application pending since ___ / is pursuing a modification]. We ask the matter remain on the status calendar pending the lender's decision. We also note the following deficiencies in plaintiff's proof: [1304 mailing / 1306 filing / standing], and reserve all defenses."
Settlement conference — Gravesend (Oct 28) / Faruolo (Nov 5)
Opening: "Your Honor, we come in good faith with written authority. Our proposal is [one sentence with the number or structure]. The gap is [one issue]." When the other side stonewalls: "We have moved [X]. We would ask the Court's assistance in getting a counter on [the one issue], otherwise we are prepared to proceed to [trial / referee / motion]." Never state a number you have not cleared with the client in writing that morning.
Non-jury trial — Faruolo (Nov 9)
Opening (60 seconds, no more): "Your Honor, this is a [__]-year marriage. The evidence will show three things: [fact], [fact], [fact]. On that record the Court should [the disposition in your Statement of Proposed Disposition]. We will call [witnesses] and offer [exhibit categories]." Objections you will actually need: "Objection — hearsay." "Objection — foundation; the witness has not established personal knowledge." "Objection — beyond the scope." "Objection — the document is not in evidence." Closing frame: tie every ask back to a § 236(B)(5)(d) factor and an exhibit number. "The Court should award [X] because [factor], as shown by [Exhibit __]."
Family Court fact-finding (Oct 30, Nov 30)
"Your Honor, [petitioner/respondent] is ready to proceed. We have [#] witnesses and exhibits pre-marked A through [__]; copies for the Court and counsel. The finding we ask the Court to make is [one sentence]." Article 10 corroboration: "Your Honor, the child's out-of-court statement requires corroboration under FCA § 1046(a)(vi); [there is none / the only corroboration is ___], and we object to the finding on that basis." If you need time: "We ask for a brief adjournment to [date] to secure [witness / records]; a subpoena was served on [date] and the return is outstanding."
The three sentences that get you out of trouble
When you do not know: "Your Honor, I do not want to misstate the record. May I have until [tomorrow / 48 hours] to confirm and submit a letter?" When you missed something: "Your Honor, that is my responsibility. Here is what I will do and by when: [one item, one date]." Then do it. When you are double-booked: "Your Honor, I have a conflicting appearance before Justice [__] in [County] at [time]. I ask for a [second call / brief adjournment / permission to appear virtually]." Say this at the START, not when they call the case.

What the bench does without being asked
1
Subpoenas (CPLR 2301–2308, 3120)
Draft the subpoena duces tecum / ad testificandum, the HIPAA authorization or so-ordered form where required (CPLR 3122(a)), serve it, calendar the return date, chase the return.
2
Certified mail with proof
Every statutory or contractual notice goes certified + first-class, with the USPS article number logged against the matter. RPAPL 1304 mailings get both receipts scanned the same day.
3
Affidavits of service
Prepared, signed, notarized, filed to NYSCEF with the document number recorded. Nothing is marked served until the proof is on the docket.
4
NYSCEF filing confirmation
Every filing you OK is confirmed by document number within the hour; the next return date is calendared.
5
Exhibit binders and docket pulls
Three sets, tabbed, pre-marked, delivered the night before. Full docket pulled and summarized before every conference.
6
Client status lines
One written line to each active client per week, from your template, for your OK.

Your team
White Knight bench
A paralegal bench sits behind this workspace. They see matters, calendar, documents and tasks. They do not see Financial picture or Economic model — those panels are attorney-only and do not render under the team access code.
How the bench works
Who
Your paralegal bench, provided through White Knight Law. Your firm; your name on every paper; their job is that nothing slips.
What they do
Everything on the Subpoenas, service & certified mail page; docket pulls; exhibit binders; NYSCEF confirmations; calendar entry; first drafts from the ATLAS templates; client status lines for your OK.
What they never do
Sign, file without your OK, give legal advice, speak to a court, or see time, billing, trust or the Financial picture.
How work moves
It appears in Approvals. You press OK or Amend. The bench executes and the proof comes back attached (NYSCEF doc no. / certified article no.).
Access
Attorney code: full workspace. Team code: everything except Financial picture and Opportunity. Two codes, one URL.
Standing weekly rhythm
1
Monday 7:00 — Week ahead is current
Calendar re-pulled from Smokeball; every appearance has its night-before list; conflicts flagged.
2
Daily 6:45 — the 5-day digest in your inbox
Start-here item first, at most three per day. If it is not in the digest it is not due.
3
Night before every appearance
Binder, docket summary, and the script for that appearance type delivered.
4
Friday — proof pass
Every filing and mailing of the week reconciled to a NYSCEF document number or certified article number. Gaps reported to you, not discovered by a court.

Practice strategy
Attorney only
The firm as a portfolio. Where the hours go, where the margin is, and the 12-month shift from volume to value. Built from your public docket mix (26 Supreme Court matters + Family Court); refine with Smokeball fee data once connected.
Where the hours go today
Matrimonial / Family Court
~30% of appearances. Emotionally heavy, fee-sensitive clients, frequent appearances, high complaint rate industry-wide. Margin: low to negative after write-offs.
Foreclosure defense
~15%. Repetitive, calendar-driven, modest flat fees; value is in the statutory defenses (1304/1306/standing) most firms miss. Margin: low, but highly systematizable.
Personal injury / City cases
~35%. Contingency; long tails (Matos since 2015); cash arrives late. Margin: fine when it closes, zero until then.
Commercial / arbitration
~10%. Full hourly rate, sophisticated clients, referral-generating. Margin: highest in the book.
Your own defense
Lamartina, Morris. Unbilled; every hour here is pure cost. Priority is to make it zero.
The shift — 12 months
1
Stabilize (now – Dec)
Close the two license matters. Put every volume file on the bench’s calendar-and-prep system so nothing slips. Connect Smokeball. Measure realized rate per matter type.
2
Systematize (Jan – Mar)
Foreclosure and Family Court become checklist-driven: the bench prepares, you appear. Raise retainers to cover actual hours; stop taking matrimonial matters below a floor retainer.
3
Reweight (Apr – Sep)
Target 30% of hours in commercial, arbitration and business-dispute work at full rate. Source: the current client’s network and White Knight referrals; co-counsel arrangements for Commercial Division depth.
4
Price (ongoing)
Flat-fee menus for foreclosure stages and uncontested matrimonial; hourly with evergreen retainer for commercial; contingency only where the file can close inside 18 months.
What it is worth
Realized-rate lift
Eliminating slippage and write-offs on volume work: +10–15% realized fees (ESTIMATE).
Mix shift
Moving 20 points of hours from volume to full-rate commercial roughly doubles revenue per hour on those hours (see Economic model).
Risk removed
No defaults, no grievance exposure, no vacatur motions: the downside that erases a year disappears.
Who does it
You practice. The bench runs the system, the calendar and the pipeline. Review monthly on this page.
Risk → cash
Attorney only
What each Tier-1 and Tier-2 action protects, in dollars and in months of revenue. Ranges come from public dockets and your matter mix; replace with your numbers. Everything is ESTIMATE unless marked CONFIRMED.
Exposure if nothing changes
Lamartina (malpractice)
Retainer at issue $10,000 (CONFIRMED in complaint) plus disgorgement, consequential damages and fees — realistic adverse range $25k–$150k. A grievance referral risks suspension: every month suspended = 100% of revenue and ~26 matters reassigned.
Morris (default posture)
A third default judgment against you personally: the judgment amount plus a reportable record that follows you into every retainer negotiation and malpractice renewal (premium +20–40%).
Missed appearance, any matter
Motion to vacate ($2–5k of unbilled time), client loss, 22 NYCRR 130-1.1 sanction exposure, and the Part’s memory. Eleven appearances in 14 days = eleven chances.
Faruolo unprepared
Matrimonial trial without 202.16 submissions = adjournment or adverse distribution findings; a fee dispute follows ($10–30k in fees and outcome at stake).
What the plan buys back
1
Settle Lamartina before RJI
Cash cost: settlement in the $10–25k range against an adverse range of $25–150k and the license. The largest single risk reduction on this page. Letter is in Approvals.
2
Clear Morris this month
Cost: hours. Return: no third default; a clean personal record on NYSCEF when any client or carrier searches your name.
3
Night-before prep on every appearance
Cost: 30 minutes per appearance, done by the bench. Return: zero vacatur motions, zero sanction exposure, and Parts that grant you adjournments when you truly need one.
4
Weekly client lines
Cost: 15 minutes Friday. Return: fewer fee disputes and bar complaints — the Lamartina complaint is, at root, a communication complaint.
Revenue side — where cash flow improves
Volume matters
Twenty files × on-time conferences = fewer write-offs and faster closes: +10–15% realized fees from eliminated slippage.
Commercial matters
One well-run Commercial Division or arbitration matter at full rate out-earns 10–15 volume files (see Economic model). The current client relationship is the pilot and a referral source.
Bench leverage
Subpoenas, service, mailings, binders, confirmations off your desk: 8–12 hours a week returned to billable or trial time.
Firm analysis
Oct 23, 2026
An honest read of the practice as a system: where the risk sits, where the revenue sits, and what structure closes the gap. Built from public dockets and the matters in ATLAS. Label: CONFIRMED = on a docket; ASSESSMENT = our read.
Risk map — by consequence
Tier 1 — License
Lamartina (malpractice, pre-RJI) and Morris (default-motion posture). CONFIRMED on dockets. Either one, mishandled, becomes a grievance referral. Both have you self-represented. ASSESSMENT: these two get the first hour of every day until resolved.
Tier 2 — Courtroom
Faruolo trial Nov 9; eleven appearances in 14 days. CONFIRMED. ASSESSMENT: the volume is manageable only if prep is done the night before, every night — which is what Week ahead is for.
Tier 3 — Revenue
Chen v. Astaire (arbitration path, Jan 18), Forza (file Monday), Elam ×2. CONFIRMED. ASSESSMENT: this client has a direct line to further referral work; deliverables here are what the relationship is judged on.
Tier 4 — Volume
~20 PI, foreclosure, matrimonial and Family Court matters. CONFIRMED by count; details not yet loaded. ASSESSMENT: steady, low-margin, calendar-heavy.
Where the practice is under-supported — and the fix
Not a critique. A solo at this volume has no back office. This is the back office.
1
Calendar lives in too many places
Five counties, two court systems, Smokeball, and your head. One missed date in Tier 1 is unrecoverable. Fix: Dashboard opens on the next 14 days; Week ahead gives the night-before list; every new date gets added the day it is set.
2
Filings are represented as done before they are verified
The Lamartina complaint turns on exactly this. Fix: nothing is marked filed in ATLAS until the NYSCEF document number is in the row. Every client-facing status goes out from a template that cites the docket.
3
Your own defense is run on the margins
Self-represented in Morris and Lamartina while carrying 26 matters. Fix: both drafts are written (CPLR 3211 motion; settlement letter to McCallion). Decide the path this week; consider having a colleague appear so your name is not on both sides of the caption.
4
Drafting starts from a blank page
Every conference, every motion. Fix: twelve drafts live in ATLAS now; each new matter gets a next-step draft the day its pleadings are loaded.
5
Communication goes quiet when the calendar is heaviest
That is exactly when clients and adversaries escalate. Fix: status-letter templates; a Friday 15-minute pass through Tasks; one written line to each active client per week, drafted here.
6
Revenue is concentrated in low-margin volume work
PI, foreclosure defense, matrimonial. Fix: the Economic model panel shows what one well-run commercial matter is worth against twenty volume files; the Chen relationship is the pilot.
What runs the firm from here
1
Monday — Week ahead
Ten minutes. Every appearance for the week, with the night-before list.
2
Daily — Dashboard, top three
Tier 1 first. Then whatever is in a courtroom soonest.
3
Friday — Tasks + client lines
Mark what moved. One written line to each active client, from the template.
4
Monthly — Firm analysis
Re-rank. Load new matters. Retire closed ones. Re-run the economic model.

Smokeball
Files, time, billing, documents, calendar sync. It records what happened.
ATLAS
Strategy and sequence: what must be true before each appearance, the draft to get there, cross-matter conflicts (e.g., Elam appears in three matters), and an economic model of the practice. It decides what happens next.

Appeal strategy
Chen v. Astaire — 653576/2026
↗
KEY OPTION — NOT YET IN PLAY
The Oct 20 order compelling arbitration is appealable as of right
30-day clock runs from service of order with notice of entry — same window as CPLR 2221
The three paths — choose one or combine
Path A
CPLR 2221 — reargue/renew before Judge Cohen · faster · cheaper · court already signaled it’s available
Path B
Appeal to Appellate Division, First Department · broader review · stronger if court overlooked law · 30-day window
Path C
Both simultaneously — maximum pressure · resource-intensive · confirm with client before pursuing
Fallback (all paths)
Commence arbitration by Jan 18, 2027 regardless — appeal does not automatically stay arbitration
Appeal as of right — legal basis
Stay of arbitration pending appeal
Practical note
File notice of appeal and move for stay at the same time. If stay is denied, commence arbitration immediately. Do not let the Jan 18 deadline pass unprotected.
Grounds for appeal
1
Arbitrability — did the court apply the correct standard?
Courts must determine whether the parties actually agreed to arbitrate the specific claims at issue. If the arbitration clause is ambiguous in scope, or if any claims arguably fall outside it, that is a reviewable legal question on appeal.
2
Waiver by defendants
If defendants substantially participated in the litigation before moving to compel arbitration, they may have waived arbitration. Did they file responsive pleadings, conduct discovery, or otherwise litigate before the motion? If so, waiver is a viable appeal ground.
3
Validity or enforceability of the arbitration clause
Unconscionability, fraud in the inducement of the clause itself, or failure of consideration are grounds to void an arbitration clause. If any of these were raised below and overlooked, they are appeal grounds.
4
Court overlooked controlling authority
Review the decision for any First Department precedent that was cited in the opposition papers but not addressed in the order. An overlooked controlling case is a strong appeal ground.
Appellate Division, First Department — key facts
Court
Appellate Division, First Department — 27 Madison Avenue, New York, NY 10010
Jurisdiction
Appeals from NY Supreme Court, NY County (Manhattan) — covers Part 03M / Judge Cohen
Briefing schedule
Set by court after notice of appeal filed — typically 6–9 months to argument
Filing
NYSCEF e-filing — same Index No. 653576/2026
Effect on arbitration
No automatic stay — must separately move for stay — Jan 18, 2027 deadline does not pause
Decision framework — what to advise client
→
If strong grounds exist for reargue: lead with CPLR 2221
Faster, cheaper, same judge who already knows the case. File simultaneously with or before any appeal to preserve options.
→
If grounds are legal rather than factual: appeal may be stronger
Appellate Division gives fresh review of legal questions. If the trial court applied the wrong legal standard on arbitrability, appeal is the correct vehicle.
→
Either way: commence arbitration as protection
CPLR 2221 and appeal do not stay the Jan 18 deadline. Commence arbitration to protect the client while the motion/appeal is pending.
Defense playbook
Lamartina — path to dismissal
709969/2026
1
Statute of limitations motion — CPLR 3211(a)(5)
Legal malpractice in NY has a 3-year limitations period (CPLR 214(6)) running from accrual — when the malpractice occurred, not when discovered. Case filed April 3, 2026. Any alleged malpractice before April 3, 2023 is time-barred. Identify the date of each alleged act on the five matters. If any predate the window, move to dismiss those claims.
File before answer or at same time — Pre-RJI posture means this window is still open
2
Failure to state a cause of action — CPLR 3211(a)(7)
Elements of legal malpractice in NY: (1) attorney-client relationship, (2) attorney’s negligence, (3) proximate cause, (4) actual damages. Plaintiff must plead actual, ascertainable damages — not speculative or contingent ones. If the complaint fails to plead a specific, recoverable loss on any of the five matters, that claim is dismissible.
3
Build the counter-record now
Pull every document, email, filing, and time entry for the five matters alleged. The defense narrative is: what was actually done, what was agreed, and what the client’s actual loss (if any) was. Blank exhibit pages and ignored matters are the allegations — the record either confirms or refutes them. Know the record before McCallion does.
4
Settlement before RJI — lowest-cost window
McCallion settles roughly 29 of every ~40 contested matters. Pre-RJI is before any discovery costs are sunk on either side. A reasonable settlement now costs less than the defense through summary judgment. Open the conversation with McCallion early — it signals competence, not weakness.
Contact: Kenneth F. McCallion + Darragh O’Boyle — McCallion & Associates LLP
5
Consider engaging defense counsel
Self-representing against a specialized malpractice firm while simultaneously running a practice is a bandwidth and credibility problem. Defense counsel may negotiate a better settlement, and their involvement signals you are taking the matter seriously — which can accelerate resolution.
Morris — path to resolution
101423/2025
1
Determine exact posture of third default motion
Two of three default motions have been vacated. Confirm immediately whether the third is pending, decided, or withdrawn. If pending and unresponded, respond now — a third unchallenged default motion significantly changes your exposure.
Check NY County eCourts: 101423/2025
2
Use 2018 history as leverage
The prior Portilla v. Morris matter from 2018 creates a documented relationship history. Depending on what that matter involved, it may support counterclaims, set-off arguments, or simply provide factual context that reframes Morris’s breach of contract claim. Pull that case file now.
3
Open settlement discussion
Three default motions in six months signals an aggressive plaintiff — but that aggression also signals a plaintiff who wants resolution. A direct settlement approach, particularly if you have counterclaims from the 2018 matter, may produce a net-zero or favorable outcome faster and cheaper than litigation.
4
Strategic priority: resolve this quickly
Morris is a distraction from higher-value work. The goal is not winning on the merits — it is removing this matter from your plate at the lowest cost so your time goes to Chen v. Astaire and income-generating clients.
MCA obligations — proactive resolution
→
CFG — approach before enforcement
The non-jury verdict ($23,749 balance) is enforceable now. A proactive structured payment approach — even modest monthly payments — stops enforcement proceedings and demonstrates good faith. Costs less than resisting a restraining notice or bank levy.
→
Blue Bar — confession of judgment (Aug 2026)
A fresh confession of judgment can be docketed as a lien. Contact Blue Bar to discuss structured resolution before they enforce. The amount is unknown — find out and negotiate.
→
The Chen v. Astaire fee solves all of this
A successful arbitration outcome generates the income to resolve CFG and Blue Bar in full. The sequence is: perform on Astaire → earn the fee → resolve obligations cleanly. Keep that sequence in view.

Affirmation in support
SUPREME COURT OF THE STATE OF NEW YORK COUNTY OF NEW YORK — COMMERCIAL DIVISION ───────────────────────────────────── STEPHEN CHEN, Plaintiff, -against- ASTAIRE CAPITAL LLC, CHRIS ELAM, and JOHN DOES 1–10, Defendants. ───────────────────────────────────── Index No. 653576/2026 AFFIRMATION OF JULIO E. PORTILLA, ESQ. IN SUPPORT OF MOTION TO REARGUE [AND/OR RENEW] JULIO E. PORTILLA, an attorney duly admitted to practice law before the Courts of the State of New York, hereby affirms the following under penalty of perjury: 1. I am counsel to Plaintiff Stephen Chen in the above-captioned action. I submit this Affirmation in support of Plaintiff's motion to reargue [and/or renew] the Court's Order dated October 20, 2026 (NYSCEF Doc. No. 34) (the "Order"), which granted Defendants' Motion to Compel Arbitration (Motion Seq. No. 001) and stayed this action pending arbitration. 2. This motion is made pursuant to CPLR 2221(d) [and/or 2221(e)] on the grounds that [SELECT: the Court overlooked or misapprehended the following matters of law or fact / new facts have been discovered that were not available at the time of the prior motion and that would change the Court's determination]. 3. [GROUNDS FOR REARGUE — describe specifically which argument made in Plaintiff's opposition papers the Court did not address in its decision, or which controlling authority was overlooked. Example: "In Plaintiff's Memorandum of Law in Opposition, dated [DATE] (NYSCEF Doc. No. [X]), Plaintiff argued that [ARGUMENT]. The Court's October 20, 2026 Order did not address this argument."] 4. [GROUNDS FOR RENEW (if applicable) — describe new facts and explain why they were not available before. Example: "Since the submission of the motion, Plaintiff has obtained [DOCUMENT/EVIDENCE], which was not previously available because [REASON], and which demonstrates [RELEVANCE TO ARBITRABILITY]."] 5. For the reasons set forth in the accompanying Memorandum of Law, the Court's Order compelling arbitration should be vacated upon reargument [and/or renewal]. WHEREFORE, Plaintiff respectfully requests that the Court grant this motion and enter an Order vacating the October 20, 2026 Order and denying Defendants' Motion to Compel Arbitration. Dated: New York, New York [DATE] ___________________________ Julio E. Portilla, Esq.
Memorandum of law — framework
SUPREME COURT OF THE STATE OF NEW YORK COUNTY OF NEW YORK — COMMERCIAL DIVISION ───────────────────────────────────── STEPHEN CHEN, Index No. 653576/2026 Plaintiff, -against- ASTAIRE CAPITAL LLC et al., Defendants. ───────────────────────────────────── PLAINTIFF'S MEMORANDUM OF LAW IN SUPPORT OF MOTION TO REARGUE [AND/OR RENEW] PURSUANT TO CPLR 2221 PRELIMINARY STATEMENT Plaintiff Stephen Chen respectfully moves for reargument [and/or renewal] of the Court's October 20, 2026 Order granting Defendants' Motion to Compel Arbitration. [SUMMARIZE IN 2-3 SENTENCES WHY THE ORDER SHOULD BE RECONSIDERED.] ARGUMENT POINT I: THE STANDARD FOR REARGUMENT IS SATISFIED A motion to reargue pursuant to CPLR 2221(d) is properly granted where "the court overlooked or misapprehended the relevant facts or misapplied any controlling principle of law." Foley v. Roche, 68 A.D.2d 558, 567 (1st Dep't 1979). The purpose of reargument is not to provide an unsuccessful party the opportunity to present new arguments, but to correct the record where the court has made an error. William P. Pahl Equip. Corp. v. Kassis, 182 A.D.2d 22, 27 (1st Dep't 1992). Here, reargument is warranted because the Court overlooked [OR misapprehended] the following: [INSERT SPECIFIC ARGUMENT — e.g., "Plaintiff's opposition established that the arbitration clause at issue does not encompass the claims alleged in the Complaint because [REASON]. The Court's Order does not address this argument."] POINT II: THE ARBITRATION CLAUSE DOES NOT COMPEL ARBITRATION OF PLAINTIFF'S CLAIMS [INSERT CORE ARBITRABILITY ARGUMENT — address: (a) scope of clause, (b) whether specific claims fall within it, (c) any applicable waiver or unconscionability arguments, (d) controlling First Department authority supporting Plaintiff's position.] [POINT III — ADD ADDITIONAL ARGUMENTS AS APPLICABLE] CONCLUSION For the foregoing reasons, Plaintiff respectfully requests that the Court grant reargument and, upon reargument, vacate the October 20, 2026 Order and deny Defendants' Motion to Compel Arbitration in its entirety. Dated: New York, New York [DATE] THE LAW OFFICE OF JULIO E. PORTILLA, P.C. By: Julio E. Portilla, Esq.

No. 34) — including the requirement that Plaintiff commence arbitration within 90 days — pending determination of Plaintiff-Appellant's appeal to the Appellate Division, First Department. GROUNDS: Plaintiff-Appellant has filed a Notice of Appeal from the October 20, 2026 Order. Absent a stay, Plaintiff will be required to commence arbitration by January 18, 2027, rendering the appeal potentially moot or prejudicially expensive if the Appellate Division subsequently determines that arbitration was improper. Plaintiff demonstrates: (1) likelihood of success on the merits of the appeal [SUMMARIZE GROUNDS]; (2) irreparable harm absent a stay [DESCRIBE — e.g., cost and burden of arbitration that cannot be undone]; (3) a balancing of equities favoring a stay; and (4) no substantial prejudice to Defendants from a brief stay pending appeal. [AFFIRMATION AND MEMORANDUM OF LAW TO FOLLOW — adapt from CPLR 2221 memorandum framework, substituting stay-pending-appeal standard from Grisi v. Shainswit, 119 A.D.2d 418 (1st Dep't 1986)] Dated: New York, New York [DATE] THE LAW OFFICE OF JULIO E. PORTILLA, P.C. By: _______________________ Julio E. Portilla, Esq.
